Terms of Service

Throwback Game Studios ("we", "our", or "us") operates D Layer, a multiplayer online role-playing game ("the Game"). By downloading, installing, or using the Game, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Game.

1. Acceptance of Terms

By clicking "I Accept" or by accessing and using the Game, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Eligibility

You must be at least 13 years of age to use the Game. If you are under the age of legal majority in your jurisdiction, you must have the consent of a parent or legal guardian. By using the Game, you represent that you meet these requirements.

3. Account Ownership

All accounts are the property of Throwback Game Studios. You may create one or more accounts, but you are responsible for maintaining the confidentiality of your login credentials. You may not sell, trade, transfer, or share your account with others.

4. Game Access and Availability

The Game is provided as-is for entertainment purposes. We reserve the right to modify, update, suspend, or discontinue the Game, or any part of it, at any time with or without notice. We may perform maintenance, deploy patches, or make changes that affect gameplay, features, or content.

5. User Conduct

You agree to:

  • Treat other players with respect
  • Not exploit bugs, glitches, or unintended game mechanics
  • Not use unauthorized third-party software, bots, hacks, or cheats
  • Not engage in harassment, hate speech, or abusive behavior
  • Not impersonate other players or staff members
  • Not attempt to disrupt the Game's servers or infrastructure
  • Not engage in real-money trading of accounts, items, or in-game currency

If you break these rules, we may restrict your account. A chat ban stops you from sending messages and from writing text that other players can see, such as chat, direct messages, and Board posts. It applies to the whole account, including every character on it, and can be lifted. An account can also be suspended, either for a stated period or until we lift the suspension. While an account is suspended, it cannot be used to play, and the Game shows you the reason for the suspension.

6. Intellectual Property

All content in the Game — including but not limited to graphics, audio, text, code, game mechanics, character designs, and world design — is the intellectual property of Throwback Game Studios. You may not reproduce, distribute, or create derivative works from Game content without our written permission.

The Game uses interface icons from game-icons.net, created by Lorc, Delapouite, Carl Olsen, John Redman, Sbed and Skoll, and licensed under Creative Commons BY 3.0 (https://creativecommons.org/licenses/by/3.0/).

7. Virtual Items and In-Game Currency

Any virtual items, currency, characters, or progress in the Game have no real-world monetary value and cannot be exchanged for real currency. We reserve the right to modify, remove, or rebalance virtual items at any time for game integrity purposes.

You can buy Diamonds, the Game's premium currency, with real money through the Apple App Store or Google Play. Diamonds are spent on services and items whose content is shown to you before you confirm; the Game sells no randomized items for real money or Diamonds. Payments are processed by the store under its own terms, including its refund policy, and we never receive your payment details. Diamonds are licensed to your account, cannot be transferred or exchanged for real money, and are lost when the account is deleted.

8. User-Generated Content

Everything you write or share in the Game, such as your character name, chat and direct messages, and posts on the Board, must comply with these Terms. You are solely responsible for the content you share.

We have zero tolerance for objectionable content and abusive users. Hate speech, harassment, threats, sexual content, and content that targets a real person are not allowed anywhere in the Game.

To keep the Game safe:

  • Offensive words are filtered automatically from chat, direct messages, and Board posts, and offensive character names are refused
  • You can report a player by tapping their name, which also flags their portrait, and report any post on the Board
  • You can block a player by tapping their name. A blocked player can no longer message you and disappears from your game: you no longer see them, their messages, posts, or listings. You can unblock them in Settings
  • We review user reports and take appropriate action in a timely manner, prioritizing serious safety concerns. When content breaks these Terms, we remove it and may restrict the account that posted it with a chat ban or a suspension, as described in Section 5

We reserve the right to monitor, filter, or remove any content and to take action against accounts that violate these Terms.

9. AI-Generated Content

The Game generates a portrait for your character using artificial intelligence. The words you write to describe your character are sent to a third-party AI provider, which paints a portrait from them over the base figure you chose.

Your words are automatically moderated before they are sent, and the generated image is automatically moderated before it is stored. Content that breaches these Terms or our community standards is refused and no portrait is produced. You must not submit words that identify or depict a real person, infringe anyone's rights, or breach the conduct rules in Section 5.

A generated portrait is shown to you first and to no one else. It becomes the face other players see only after you accept it, and we may remove an accepted portrait at any time if it breaches these Terms.

AI-generated output can be imperfect or unexpected. We make no guarantee about the likeness, accuracy, or quality of a generated portrait. Generated portraits are Game content under Section 6, are licensed to you for use inside the Game only, and, like every other virtual item, have no real-world monetary value.

10. Privacy

Your use of the Game is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By accepting these Terms, you also acknowledge our Privacy Policy.

11. Modifications to Terms

We reserve the right to update these Terms at any time. Material changes will be communicated within the Game or via email to registered users. Continued use of the Game after changes are posted constitutes acceptance of the updated Terms.

12. Limitation of Liability

The Game is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Game, including but not limited to loss of data, loss of progress, or interruption of service.

13. Indemnification

You agree to indemnify and hold harmless Throwback Game Studios from any claims, damages, or expenses arising from your use of the Game or your violation of these Terms.

14. Termination

We reserve the right to suspend or terminate your access to the Game at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Game ceases immediately.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Brazil. Any disputes arising from these Terms or your use of the Game shall be resolved in the courts of Brazil.
